About Design ‘N Gather 2018
At the intersections of digital and physical, art and technology, Artaic continually stretches the bounds of what can be designed in tile, and we are welcoming you to do the same. Together we invite designers from all backgrounds to become digital mosaic artists.
We will provide you with proprietary software with which to create your own original design, which can be submitted to the Contest for the opportunity to be produced by Artaic.
The Contest welcomes designers from all disciplines: architecture, product design, fashion, interior design, photography, painting, furniture design, and any other creative field to come together, pick up new tools and create a one-of-a-kind piece that has a lasting impact on the space and on the individuals that experience it.
Eligibility
The Contest is open only to residents of the 50 United States, the District of Columbia, and Canada, who are age 21 or older. Participation is open to applicants from all design backgrounds including professionals, students, and design-enthusiasts. Employees of Artaic, LLC, Bostik, Inc., Sydell Group, Boutique Design (“Sponsors”), and their respective affiliates, subsidiaries, advertising and promotion agencies and family members (spouse, parents, children and siblings and their spouses) and individuals living in the same household of such employees are ineligible to participate in the Contest. This offer is void wherever prohibited. By participating, entrants agree to be bound by and comply with these official rules and applicable laws. The Sponsor(s) may report, as required by applicable statute or regulation, the value of the prize and the identity of the winner to appropriate taxing authorities. ALL TAXES ARE THE SOLE RESPONSIBILITY OF THE WINNER.
How to Enter
The Contest starts on June 22, 2018, at 12 pm (EST) and submissions are due no later than September 1, 2018, by
Winner Selection Process
Through a blind judging process, a jury of design professionals will review all entries and select the best finalists. The finalists will be picked based on the creativity, execution, and successful interpretation of thematic elements. Finalists will be announced in early September. From those finalists, one will be selected as the winning submission. The winning mosaic will be permanently installed at the NoMad Hotel and unveiled at Design N Gather 2018 on November 11, 2018. This winning mosaic display remains the property of the Sponsors.
Prizes
Please see a detailed list of prizes below. Delivery of prizes will be coordinated with their respective winner after November 11, 2018, when finalists are announced.
Top 10 Finalists will receive:
- Personal Tour of Artaic facilities with Founder & CEO Ted Acworth, during your next visit to Boston, Massachusetts.
- Decorative sample booklet of your design (Estimated Value: $500).
- Featured in Boutique Design and at BDNY.
- Two tickets for Design N Gather 2018 at The NoMad Hotel (Value: $100 per ticket).
The Winner will receive:
- Free trip for two to Paris, France (airfare and hotel) (Value, not to exceed: $5,000).
- Publicity and press coverage at BDNY as selected by Sponsors (Estimated value: $15,000).
- Extra ticket for DNG 2018 at the NoMad Hotel.
- Plus all of the aforementioned items that the top 10 finalists receive.
Prize Restrictions
No substitution or transfer of prizes is permitted except at the sole discretion of Sponsors. In the event a prize is unavailable, Sponsor may substitute prizes of equal or greater value. By accepting a prize, the winner agrees to the release of his or her name and/or likeness for potential publicity purposes, where permitted by law.
Limitation of Liability/Release
By entering, participants agree to be bound by these rules and the decisions of the judges, Artaic, LLC, and Bostik, Inc. which shall be final. Artaic, LLC, Bostik, Inc. and the employees, officers, directors, shareholders, agents, and representatives of Artaic, LLC, and Bostik, Inc. affiliates, subsidiaries, and advertising, promotion and legal advisors are not responsible for and shall not be liable for: (i) late, lost, delayed, damaged, misdirected, incomplete, illegible, or unintelligible entries; (ii) telephone, electronic, hardware, or software program, network, Internet, or computer malfunctions, failures, or difficulties; (iii) errors in transmission; (iv) any condition caused by events beyond the control of Artaic, LLC or Bostik, Inc. that may cause the Contest to be disrupted; (v) any injuries, losses, or damages of any kind caused by a prize resulting from acceptance, possession, or use of a prize, or from participation in the contest; or (vi) any printing or typographical errors in any materials associated with the Contest.
THIS CONTEST IS PROVIDED, AND THE ARTAIC SOFTWARE IS PROVIDED, “AS IS” WITHOUT ANY WARRANTY, EXPRESS, IMPLIED, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, OR ANY WARRANTY REGARDING TITLE OR AGAINST INFRINGEMENT. IN NO EVENT SHALL ARTAIC, LLC OR BOSTIK, INC. BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES (INCLUDING, BUT NOT LIMITED TO, PERSONAL INJURY, DEATH, LOSS OF USE, DATA, OR PROFITS; OR BUSINESS INTERRUPTION) HOWEVER CAUSED AND ON ANY THEORY OF LIABILITY, WHETHER IN CONTRACT, WARRANTY, STRICT LIABILITY, NEGLIGENCE OR TORT, ARISING IN ANY WAY OUT OF THE
Neither Artaic, LLC, Bostik, Inc., nor the prize suppliers are responsible for printing or typographical errors in any Contest-related materials; or mail that is stolen, lost, late, misdirected, damaged, incomplete, illegible or postage-due. By participating in this Contest and accepting a prize, winner agrees that Sponsors and their respective affiliates, agents and promotion agencies shall not be liable for any and all losses, damages, rights, claims, and actions of any kind in connection with the Contest or resulting from the winner’s participation in the Contest, acceptance, possession, use, or misuse, of any prize, including without limitation, personal injury, death, and property damage, and claims based on publicity rights, privacy or defamation. Artaic, LLC and Bostik, Inc. reserve the right to cancel or modify the Contest if fraud or technical failures compromise the integrity of the Contest, as determined by Artaic, LLC and Bostik, Inc. in their sole discretion. Artaic, LLC and Bostik, Inc. reserve the right, at their sole discretion, to disqualify any individual who tampers with the entry process or otherwise violates any of the rules of the Contest.
The Winner will be required to sign and return an Affidavit of Eligibility and Release of Liability/Publicity, in a form as provided to the Winner, before such Prize will be awarded. Winner will be required to return documents within fourteen (14) days from the date of the prize notification email. Failure to comply with this requirement or return of prize notification as undeliverable will result in forfeiture of prizes.
Permissions
By creating Designs with Artaic’s Software, design tools, or uploading Designs to the Software or Site, you grant the following licenses to Artaic, LLC and Bostik, Inc.: the nonexclusive, worldwide, transferable, sublicensable right to use, reproduce, publicly display, and distribute such Design in advertising, marketing, samples, and promotional materials for the purpose of promoting the Software and Artaic, LLC or Bostik, Inc. products and services; and the right to make modifications to your Design as necessary to prepare your Design for promotional use. Artaic, LLC and Bostik, Inc. encourages the promotional use of your Designs, so long as you attribute Artaic on your Designs.
Entrant’s Representations and Warranties
By participating in the Contest, the Entrant warrants and represents in connection with the Entry submitted as part of his/her participation in the Contest: (a) he/she is the sole and exclusive owner of (and free of any adverse claim by any person, firm, or corporation) all intellectual property rights in and to the Entry; (b) the Entry is original and the use of the Entry as described in these Official Rules will not infringe the rights, including without limitation the intellectual property rights, of any third party; (c) the use of the Entry, as described in these Official Rules, will be in compliance with any third-party licenses pertaining to the Entry; (d) the Entry is not obscene or libelous, and does not violate any rights of any third party, including but not limited to rights of privacy or publicity; (e) the Entry does not contain any virus, spyware, malware, trap door, worm, or any other device, mechanism or code that is injurious or damaging to software or hardware used in conjunction with the Entry; (f) the Entry and its use as described in these Official Rules will not violate any federal, provincial, state or local laws or ordinances; (g) no employer or educational or other establishment has any rights in the Entry; (h) the Entry is consistent with these Official Rules; and (i) he/she has the right to grant the license to Artaic, LLC and Bostik, Inc. as required in these Official Rules.
Consideration
The Entrant agrees that the ability to participate in the Contest and to compete for the prizes offered in connection with the Contest constitute, where required, sufficient consideration for the Entrant’s obligations under these Official Rules.
Governing Law
The interpretation and enforcement of these Official Rules will be governed by the laws of the Commonwealth of Massachusetts, USA. The Contest is subject to all applicable, as the case may be, national, federal, provincial, state and local laws. The Entrant, Artaic, LLC, and Bostik, Inc. agree to the extent permitted by law to submit all disputes arising out of or relating to these Official Rules or the Contest to, and hereby waive any objection to the exclusive jurisdiction and venue of, the state and federal courts located in Suffolk County, Massachusetts. If necessary any provision of these Official Rules which is found to be invalid by a court of competent jurisdiction shall be deemed to be struck. out. From these Terms and Conditions.
